Conditions of sale
1. Validity of the conditions of sale
1.1. The Terms and Conditions of Sale apply to the purchase of goods and services from the Duris.ee online store between the buyer (hereinafter referred to as the Consumer) and Duris OÜ (hereinafter referred to as Duris.ee).
1.2.In addition to these Terms and Conditions, legal relations arising from the purchase of products from the Duris.ee online store are governed by the Law of Obligations Act (hereinafter referred to as LOA), the Consumer Protection Act (hereinafter referred to as the Consumer Protection Act) and other legislation in force in the Republic of Estonia.
1.3. Duris.ee reserves the right to make changes to the Terms and Conditions of Sale. Duris.ee reserves the right to make changes to the terms and conditions of sale.
2. Pricing information
2.1 All prices in the Duris.ee online shop include VAT at 22%.
2.2 For purchases with a total amount of less than 50 euros, the price of transport to Estonia will be added according to the mode of delivery chosen by the Consumer.
2..3. The prices are valid from the moment the order is placed until the expiry of the payment term of the placed order (24 hours after the order is placed).
2.4. If the order is placed before the terms of sale or prices are amended, the legal relations between the Consumer and Duris.ee shall be governed by the terms in force at the time the order is placed.
2.5. Duris.ee reserves the right to make changes to the sales prices. Such changes will be reflected on the Duris.ee website.
3. Place an order
3.1. Add the products you wish to order to your shopping cart.
3.2. To place an order, click on the “Place an order” link in the shopping cart.
3.3. On the place an order page, fill in the required fields, select the delivery method and payment method that suits you and click on the “Place order” link. You will then be redirected to the bank to pay the invoice. If you choose to pay by bank transfer, an invoice will appear on the screen, which you can pay at your preferred bank/ or by card payment.
The details for making a payment in euros, including all applicable national taxes and surcharges, can be found on the invoice displayed on the screen after you have confirmed your order.
3..4. Please fill in the fields on the data and order confirmation page carefully, as the accuracy and correctness of the information provided will determine the prompt and smooth delivery of the products you have purchased and the subsequent settlement of any disputes and claims.
3.5. Orders placed in the Duris.ee online shop will be processed on working days Mon-Fri 9:00-17:00.
3.6. It is not possible to combine orders placed separately, even if they are placed within the same calendar day. Please add all the products you wish to order to one basket and place one order. Once you have added all the products you want to your shopping cart, confirm the order. Only a single delivery charge is payable for a single order.
4. Entry into force of the sales contract
4.1. By the sales contract Duris.ee undertakes to transfer to the Consumer the Goods existing, to be manufactured or to be acquired by Duris.ee in the future and to enable the transfer of ownership to the Consumer, while the Consumer undertakes to pay Duris.ee the amount indicated on the invoice for the Goods and to accept the Goods.
4.Orders for which payment has not been made shall be cancelled 24 hours after the order has been placed.
4.3 The sales contract shall enter into force upon receipt of the payment made by the Consumer into the bank account of Duris.ee.
5. Delivery
5.1 After the sales contract has entered into force, Duris.ee will bundle the order and hand it over to the company’s logistics partners for delivery.
5.2 The delivery deadlines indicated on the e-shop website are valid from the moment the order amount is credited to the Duris.ee bank account.
5.3 In order to ensure delivery without delays, care must be taken to provide correct and valid information when entering delivery details when placing the order.
5..4. Duris.ee shall not be liable for any delay in the delivery of the goods if the goods have been handed over to the logistics partners on time, but the delay in delivery is due to circumstances beyond Duris.ee’s control and foreseeable.
5.5. Upon Duris.ee’s written request, the customer shall be obliged to cover Duris.ee for all damages related to the delivery and return of the goods. If the Consumer has not informed Duris.ee in advance of the refusal to accept the order, Duris.ee shall interpret this as an abuse and Duris.ee shall be entitled to claim from the Consumer the payment of the transport costs.
5.6. If you notice that the packaging of the delivered package is damaged (wet, wrinkled or otherwise externally damaged), you undertake not to accept the package from the courier. If you notice that the packaging of a parcel delivered by DPD or Itella parcel service is damaged, please inform Duris.ee immediately by phone or e-mail (if you inform Duris.ee by e-mail, please attach a photo of the damage to the e-mail attachment, if possible).
6. Right of return
6.1 The Consumer’s right of return is provided for by law and is not a specific feature of ordering from the Duris.ee online store.
6.2 After receipt of the order, the Consumer has the right to withdraw from the contract concluded in the e-shop without giving a reason within 14 days. According to Section 53(4) of the LOA, the Consumer does not have the right to withdraw from the contract in respect of goods that cannot be returned due to their nature. Cosmetics and perfumes, among others, are not subject to return.
6.3. In order to return the goods, the Consumer must submit a free-form application for withdrawal from the purchase of the goods to orders@duris.ee within 14 days of receipt of the goods at the latest. If you wish to return two or more orders to Duris.ee in a single package, the free-form declaration to this effect must be included in the Goods withdrawal form sent to orders@duris.ee.
6..4. The consumer must return the goods within 14 days of submitting the declaration or provide proof that he/she has handed over the goods to the logistics company within the aforementioned period.
6.5. The consumer does not have to return the goods via the logistics company if Duris.ee has agreed to collect the goods itself.
6.6. The following conditions must be complied with when returning the goods:
- the returned goods must be in their original, correct manufacturer’s packaging;
- the product must be undamaged;
- the goods must be unused and retain their commercial appearance – labels must be intact, protective films must be torn, etc;
- the goods to be returned must be the same set as the one received by the buyer;
- place the products to be returned in additional protective packaging (for transport), e.g. a box or envelope.
6.7. The consignment must contain: the products (with labels and in the original packaging) and a declaration of withdrawal from the purchase of the goods previously sent to the e-mail address orders@duris.ee.
6.8. The Seller has the right to refuse to accept the goods returned by the Buyer if the conditions for returning the goods have not been complied with.
6.9.When returning the goods to Duris.ee, the return fee is 4 euros. The return fee shall be deducted from the amount of money to be returned to the Consumer.
6.10. Duris.ee shall, upon receipt of the notice of withdrawal, immediately, but not later than 14 days after the receipt of the notice of withdrawal, return to the Consumer all fees received from the Consumer under the contract, except for the return fee of EUR 4.
7. Force majeure
7.1 Duris.ee shall not be liable for any damage caused to the Consumer or delay in delivery of the goods in the event that the damage or delay in delivery of the goods is due to circumstances that Duris.ee could not influence or foresee.
8. Protection and processing of personal data
8.1. The Customer’s personal data are processed in accordance with the Personal Data Protection Act.
8.2. Duris.ee collects the Consumer’s personal data when creating a customer account and/or placing an order.
8.3. The personal data processed are the Consumer’s name, mobile phone number and e-mail address. If the delivery method is DPD courier or the order exceeds EUR 150 (excluding VAT), the street, city and postal code must also be indicated.
8.4. Duris.ee uses personal data to provide services to the Consumer, to further develop and personalise the services. These services are in particular to be understood as the sale of goods to Consumers on the Duris.ee website and the organisation of personalised offers.
8.5. By entering data in the online shop and by giving his/her consent, the Consumer authorises the collection and processing of the Consumer’s personal data and the transmission of the data necessary for the delivery of the goods to the logistics partner.
8..6. Duris.ee has the right to use the Consumer’s residential or business address for the purpose of sending advertising and other information to the Consumer.
8.7. The Consumer has the right at any time to prohibit the collection and use of his/her personal data, unless this is necessary for the collection of a claim arising from the contract or for the delivery of the goods. Consent to the use of the aforementioned personal data may not be withdrawn retroactively.
8.8. The use of electronic personal data for direct mailing purposes shall only take place if the Consumer has given his/her consent to this on the Duris.ee website.
8.9. Encrypted data communication with banks when paying for purchases ensures the security of the Consumer’s personal bank details, which are not accessible by Duris.ee.
8.5..10. Duris.ee does not transfer personal data received about the Customer to third parties.
8.11. Privacy policy/data security – reference to the use of SSL, MasterCard SecureCode, Verified by Visa when requesting card details; use/non-use of personal data provided by the Customer to the Company; information that the merchant does not see the card details entered, the Customer is redirected to the secure environment of Nets Estonia for the card transaction. At the time of payment, the cardholder’s card details are entered by the cardholder into a database located on the Nets Estonia server and the data is also stored in Nets Estonia;
9. Procedure for filing complaints
9.1 The replacement of defective goods shall be agreed between Duris.ee and the Consumer.
9.2 Duris.ee shall not be liable for defects in the product caused by the Consumer as a result of improper storage or improper use of the product.
9..3. In the event of non-conformity or defects of the product, please send a complaint to orders@duris.ee, indicating the name of the person placing the order, contact telephone number, order number and a precise description of the non-conformity or defect.
9..4. Complaints regarding non-conformity or defects must be submitted within two days of the discovery of the non-conformity or defect.
9.5. All complaints will be reviewed and the Consumer will be contacted as soon as possible, but no later than 14 days from the date of receipt of the complaint.
